Legal Question in Wills and Trusts in California
My father died and left my stepmother as trustee. The trust was split into a survivor's trust and a bypass trust. My stepmother decided which properties would go into each trust. She has discovered she can not re-fi the properties in the bypass trust and now wants us(the beneficiaries) to pay for the maintence, since we will be inheriting the properties when she dies. She has also offer to loan the trust the money for the maintence, but we have to pay her back. Are we responsible for paying the maintence on these properties? And can she do the loan and force us to pay her back?
