Legal Question in Wills and Trusts in California

Husband's Pension

Can an ex-wife of deceased husband

(died in FL) be eligible for his

pension? The marriage lasted 30

years and ex-wife is now receiving

survivorship benefits from social

security. Or, does the money legally

go to the children of the estate (3)?

Re: Husband's Pension

Anybody who was married for 10 years can be eligible for social security survivorship benefits, this is independent of other rights.

Who might (or might not) be eligible for some other type of pension depends on what type of pension, the claimant's relationship if any to the decedent, the will or other instructions of the decedent, and the applicable state law.
