Legal Question in Wills and Trusts in California

We have a Living Trust and would like to amend or modify the trust. I have used the downloaded software from FindLegalForms.com and prepared a document of Amendment to delete or remove a specific paragraph of the original trust which creates a Trust A if one of us should die first. It does not change anything about the final beneficiaries and it looks good to me as a former Legal Assistant for about 15 years at a law firm. How can I explain this to my wife who is the one who wanted to have the change made that it is legal and to proceed?

Thanks for help.

Wayne

In the first place, since we have no way on knowing what you wrote on the amendment, we cannot comment on its legality. Perhaps your wife would prefer to have an attorney draft the amendment.

Scott Jordan has given you good legal advice. The wife should have her own representation to draft the amendment, and maybe you should consider having an estate planning attorney to draft the trust for you, rather than using a form off the internet; of course you consult Findlegal Forms to advise you.
