Legal Question in Wills and Trusts in California

My mother left a will in 1977 leaving her UK estate equally to my brother and myself. In 2006 she wrote to her attorney handling her estate in England, asking the firm to amend the will and put the estate in a living trust to myself only with rights of survivorship. The attorney responed saying she was US domiciled reiterated that I would hold title to the properties and all rents from that day forward but he never followed through with her request and now she has passed away and my brother is trying to fight me for half of the estate. can you give any advice about what to do from here. It is also interesting that she, living here in the US since 1970 that the attorney was the property manager, the seller of certain flats and the banker and keeper of all funds involving the properties and advising her to sell off certain ones that were more expensive. Yet, the monies that she made from the rents for all properties were not put in to a higher yeild account but were kept in a regular savings with a very low interest rate. There is no documentation from him advising her to invest quite a large sum.
