Legal Question in Wills and Trusts in California

Removal of Occupant to sell home

According to the trust, I am the Successor Trustee and it is my job to sell the house left in my Mothers' Trust. It was left in equal shares to me & my 2 sisters. The question is how do I get my one sister who is living in the house to get out so we can sell it? At the present time she is living in it and refuses to move. We had the house on the market but she attacked the real estate agent trying to sell it for us and we have been stuck since that time.

You may evict her; I would only do so after most reasonable attempts to reason with her. It may be better for an attorney to do it for better chance of settlement and to be the fall guy. Call me directly at 16192223504

You need to evict your sister. As the successor trustee, you are the new owner of the home. As the owner, you are entitled to remove tenants that do not have the right to be living in the home. See an attorney for more assistance.
