What are the steps to declare brother legally dead

My brother has been missing 10 yrs. last known address is in jax., fl..have had internet detective search done of his social security no..nothing since 1995..as far as I know, he owns no property..has no close contacts, noone has heard from him and attempts to find him have been unsuccessful, he has always been flighty..for legal reasons, now i need to have him declared legally dead...what are the steps to do this, and....if by chance he is incarcerated somewhere in the U.S...would that show in the social security check...

our father left an insurance policy when he died last year, and I need to get legal status of death or locate him..what do I do from here?
