Legal Question in Wills and Trusts in California

tangible personal property

are common stock time shares considered tangible personal property? Will left all personal tangible property and insurance of such property to heirs, and residue of estate to another, owned real estate not clarified as residue or personal property.

Re: tangible personal property

It depends if you own a property interest in it (meaning do you pay property tax seperately). If this is the case, then it is most likely "real property". If not, then it most likely falls under "non-tangible personal property". Either way it is most likely not "tangible personal property". Meaning the way you described the will, it falls into the residue.

Really though, if you have a will with this kind of confusion in it, you should hire an attorney to go over it. The way the will is written might affect the disposition of the property.
