Legal Question in Wills and Trusts in California

Who Get's The Title to the Home?

When my Father died in the early 60's my Mother got the house. She gave the home to my Brother years later and he put my name on the house so it is a Brother and Sister combination on the title. Now my Brother has a Woman living with him and he has an Adult Daughter. The Mother was told to leave but she won't and his Daughter is in and out depending on her Drug habit. If my Brother passes away who will get the house? Does the Woman he lives with or his Daughter have rights to the house?

Re: Who Get's The Title to the Home?

It depends on how title is held, i.e., whether you are tenants in common or joint tenants. Depending upon how title is held it is possible that you get it all OR just that portion that your brother previously transferred to you.

I would get copies of the title and meet with an attorney who can give you better information with the records.
