Legal Question in Workers Comp in California

i am from ca i injury my right foot that lead to rsd that cause me to hurt my back i was injury in 2003 and settled in 2005 reopen my case , my lawyer said i was 44% injury and to take that with medical life or he said if i take it wcb trial i would get 63% if i win or i could loss and get nothing. so what should i do?

Have your lawyer explain in detail why the various results might occur. Tell him/her that you need a second opinion because of the importance of this issue. See if you can find another WC lawyer who is willing to review the medical records and reports and give you their opinion [they would have to work out some payment plan with your current attorney]. Figure out what the difference is between the possible awards and whether it is worth the gamble. Without reading at least all the final medical reports, no attorney can tell you what your chances of success are.
