Legal Question in Workers Comp in California

Continual Trama

I have an old WC claim older than 5 yrs with medical still open. My neck has deteriorated twice as much as when the first claim settled and I now need surgery. I also feel in the parking lot in Nov 2007 and went to get stiches in my arm. I notified the manager when it happened and before my husband came to take me to the dr for stitches. The fall was one of the reasons my neck got worse, but the manger never filled out an incident report. What can I do since I can't reopen my old case, but am covered medically. I would still like to be covered fully to protect myself now that I have to have the 2 disc fusion of my neck. I don't know if I should open another workers comp for continual trama?

Re: Continual Trama

You can't re-open your worker's compensation because the aggravation of your old injury is not work-related. You can file a personal injury claim against the owner/operator of the parking lot. Call us at 213.388.7070 for a free consultation.
