Legal action against Work or Manufacture

My question ,

I was at work, I just sat in the chair @ my work station . I started to sit back into my chair, for support for my back. Next thing I heard was a loud crack, and I fell back wards, hitting my head and neck, shoulder and hand/wrist area on the safe and floor behing me. In no way did I have the wheels off the floor. The leg just broke. ( I have a witness ).

Is it the fault of my work or is it the manufacture of the

chair?

not your problem

You file a workers' compensation claim. The attorney for the insurance carrier has the responsibility to determine if there should be subrogation.

The only civil suit you can bring is products defect, and for that you need a consumer advocate. They ususally take the case on contingency, but only have time for big cases, with lots of defendants.
