Legal Question in Workers Comp in California

Reopening Claim & Life Time Medical

My claim was filed 6/2000 & settled in 6/2005 I was determined to be permanently disabled unable to gain employment and awarded life time medical. I recently found my condition is worse. I had an injury to my upper back & neck; now I have bulging discs in my lower back. My claim covered my entire spine. The Work Comp Ins. Carrier has been after me to cash in my life time medical. At the time my claim was settled they told me I would be able to obtain medical care if I moved to Arizona. Since the comp reform now there are no doctors in their network in that state. I was never notified of my rights under the new California Comp reform. Can you help? Can I reopen my claim? Thank you.

Re: Reopening Claim & Life Time Medical

If your injury occurred in 2000 you cannot re open for new and further disability. However you can go to court for an expedited hearing and for penalties if they are now honoring the Award. Yes I can help. Many attorneys may not want to help as they feel they may not get fees. However, I can see you need help and someone has to take these insurance companies to task.
