Legal Question in Workers Comp in California

can i sue the ame for medical malpractice in the state of ca? he has jepordized my health and thank goodness 2 wcab judges did not agree with him and my primary surgeon. there were numerous errors along with incompetent prior reports. How cam you have a 1 inch scar with a triple lumbar fusion? Also no anterior scar noted at all. many more errors in his reports, What can be done about this?

No, you can not sue for an erronous medical report on a WCAB case. Writing an incompetent report is not malpractice. You can complain to the WCAB about the report and Dr. but can not sue him. Moreover, since the judges did not accept his opinion you did not really suffer any recoverable damages.
