Legal Question in Workers Comp in California

Temporary Disability

I recently veiwed my WC file and found out I have been under paid for the last three years of $125 wkly.I think they must have been calculating on bases of hrly for 12 mnths with no over time. I worked in a hospital all shifts and tones of OT. What should I do? How should I ask them for this. I tried to get a wage summery. Aren't the adjusters like our employer? thanxs for your help!

What you should do is consult an attorney who knows this area of the law. You probably already have one for the claim. Go back to him/her and explain the situation.

Aren't the adjusters like our employer? The adjuster's job is to save as much money for the insurance company or self insured employer that he/she can. They look good to their boss when they pay as little as possible on claims. Their allegence is to their employer. (This is saying what I think in a nice way.)
