Legal Question in Credit and Debt Law in Canada

Fitness World Gym Contract cancellation

My son has a 2 year contract with Fitness World. He is no longer attending due to work hours, etc . He wishes to cancel but they are sending debt collection letters to him demanding payment of $500.00 to fulfill the contract. Is he legally required to pay this money?

Re: Fitness World Gym Contract cancellation

Assuming it is a valid contract - i.e., your son was at the age of majority when he entered the agreement and he agreed to pay the gym in exchange for receiving the benefits of membership - then he is legally obligated to honour the terms of the agreement.

I suggest that you review the contract terms and determine if there is a termination provision. If there is then do whatever is required to terminate the agreement.

Alternatively, the contract may provide a membership "freeze" or a suspension of the membership in certain circumstances.
