Legal Question in Family Law in Canada

Interim Order

I'm going to court and i want my lawyer to start something called an interim order because i've been locked out of my home, no car and no money for 40 days. How long does this take to start if our first court appearance is Jan 30th. Also how long will the judge give my xcommonlaw husband for this interim order to be enforced.

Re: Interim Order

You haven't really given enough information for a complete answer to be provided; you haven't said what sort of interim order you want (an interim order is just a temporary order that is in place while things are sorted out, and there are several kinds. You should see why your lawyer is not acting faster - there may well be valid reasons. As to how long the judge will give your ex-partner, that is dependant on the type of order you wnat, the urgency of the situation and other factors. There is also no guarantee that you will get the kind of order you seek, as the court will try and be fair to both of you and what you seek may well be too one-sided.
