In criminal matters, the expression "dismissed as abandoned" is usually heard in a court of appeal.

As an example, an appelant may file an appeal against a conviction rendered by a lower court. Should the appelant decide not to pursue the appeal after it is filed, the court will dismiss the appeal as abandoned.
