Can I file for bankrupcy

If I am in the middle of a divorce proceeding can I file for bankrupcy even if my spouse does not want too.

Yes, Colorado is NOT a community property state and you may file bankruptcy yourself WITHOUT your husband. However, who ever prepares your bankruptcy petition will need to review the divorce proceedings to determine if you will be entitled to any assets after the divorce as well as the child support. Both of these involve money and must be properly recorded on your bankruptcy petition.
