Had a person that I was doing labor for on an hourly basis want to put me into business. Suppose to be a partnership but never signed any documents. Verbal agreement was that I do work for him very discounted and he pays for equipment and insurance. He made the down payment on both and hasn't paid a thing for them since then, starting in February. May 21, 2008, calls and tells me he is not paying for the equipment or insurance or for anything for my company which he had created.--name removed--Excavation & Construction, LLC. I found out that I owe the equipment company and the insurance approx. 13,345.11 and have made payments on the equipment because they have already threatened to take them from me (finance Co.) He owes me and employees 10,940.00 for labor. I was doing work for him at the time he told me that so I invoiced him under normal conditions and he owes me 21,890.00 for them. He has told an office associate that he is not going to give me any more money. Out of the 21890. he owes me 10,590 is for trucking and is due a trucking company. I don't believe he is going to give me anymore money and I will lose my business. I am also a veteran and can't believe someone could be this way. Thank you in advance.

Sorry to hear about the problems. You really should have had a written agreement before you paid a penny or did any work.

Either come to some agreement or you will need to file suit. Since the amount due is above $15,000, you will need to file in district court, which is complicated. Contact an attorney to discuss options.

You need to speak with a good litigation attorney familiar with partnership law about this one. Seems you may have a claim that the equipment and insurance costs were partnership expenses.
