Legal Question in Civil Rights Law in Colorado

17 and have no where to go

Two days ago my boyfried was caught stealing at Kmart. Since he stole a tube of mascara the store charged me with theift as well and I ended up going to a juvinial holding cell for hours until my mom would pick me up. Now my mom is trying to kick me out of the house and I have no where to go or anyone to turn to. Do I have any legal rights in this matter regarding the theift in the first place and/or my mom kicking me out? please help me I am desperate.

Of course you have legal rights regarding the theft; the prosecution has to prove beyond a reasonable doubt that you stole. If the object was in the possession of your boyfriend there is plenty of doubt. Plead not guilty.

Make nice with your mother. Without a court order she can't kick you out; if she does, go to the police. But don't let it get that far. Tell your mom you love her (unless you really don't) and that you have no place else to go.

Good luck.
