Contract Law

My Daughter who is 16 years old, signed a contract with a health club without my knowledge or permission. She now has been sent to collection for failure to pay. her monthly payments.

Is this legal? If not, how should I handle this? Letter to collection agency, or? I'm I responsible?

You are probably not responsible. Send a letter to the collection agency with a copy of your daughter's birth certificate. (Send it registered mail, return receipt requested - and keep a copy of your letter!)

Check with the local Better Business Bureau to see whether there have been other compalints against this health club.

To be on the safe side, see a lawyer. If you can't afford one, go to the Legal Aid Society. Most bar associations also have panels of lawyers willing to work for reduced fees.

You are not responsible AND your daughter is not responsible for the bill.

Don't let her sign any new contracts.
