there must be some evidence of your involvement in distribution - this can be wiretaps, controlled buys from you, or possibly a statement by someone that bought or shared drugs with you (unless it is a small quantity of MJ, then a drug passing from your possession to another person is distribution, even if not sold) - NFL player Jamaal Lewis was convicted on conspiracy to deal drugs for dialing a phone number and and handing the phone to someone else

There could be a case depending on the evidence. For example, I have represented many people charged with distribution where there are no drugs found but there are wiretaps of phone calls setting up deals, controlled buys, recordings of deals with wires and snitches. There is always a case. How good a case there is, is part of the lawyer's job to find out. Police do not need to have found drugs anywhere near you to have a case against you for distribution. Do yourself a favor and get a lawyer.
