Legal Question in Criminal Law in Colorado

Victim of Domestic Violence

I was assaulted. I originally told police it happened at a different location because he was not on the lease and destroyed my house. He definitly assaulted me, just at a different location than I orginally reported. If I change my story before it goes to trial will he get set free? Will I be charged for making a false statement? I dont want him to get away with it based on this one detail. He assaulted me, but i did tell the police a different story at the time to protect myself from being sued by my landlord.

Re: Victim of Domestic Violence

You should talk with the DA handling the case and come clean about this and anything else you said that wasn't the strict truth. You have certainly damaged your credibility, and a defense attorney like me will do everything possible to make a jury believe you're a habitual liar.

You are unlikely to be charged with making a false statement, unless the statements central to proving the assault charge were likewise false.

Assuming there is other proof (besides your now-questionable word) that the assault occurred, the DA may well decide to pursue the case.

Good luck (and despite what I said about defense attorneys, I mean it).
