Legal Question in DUI Law in Colorado

First DWAI

I was driving to a Boulder hotel after a wedding and got pulled over for speeding (15 miles over). The officer said I smelled of alcohol but I refused the roadside test. At the jail I blew a .067 and was released 4 hrs later. I 've only had a speeding tix 3 yrs ago, what can I expect for a plea bargain? Do I need a lawyer?

Do not plead to DWAI. You need a lawyer. I would insist on a non alcohol plea or take the case to trial.

Your breath alcohol level is low enough to where an attorney may be able to negotiate a non alcohol plea agreement. You may also decide to make the government prove your guilt and you can be aggressive in challenging every aspect of the case. Your options are to meet with the district attorney and see what they offer or you can hire an attorney to review the matter and negotiate on your behalf. I have handled similar situations with success. I would be happy to meet with you at your convenience.

I am very familiar with the Boulder process. My office is just around the corner from the courthouse.

Although you may not need a lawyer, in this circumstance, it is best to have one so that the case is resolved quickly and correctly.

You should not take any plea with drinking and driving as a component.
