Officer missed the DMV hearing... what next?

DUI Colorado, my friend checked the box that she would like to have the officer present at the hearing on the off chance that he wouldn't show up... which we were told never happens. However, it did happen and they handed her license back to her. But now she is told that the judge will hand it to her (on a silver platter) in county court and she will still lose her license and maybe even for longer with more restrictions. How was not having officer present beneficial? Confused!

Well, it is good that she won the DMV hearing bc she will not lose her license immediately. She will only lose her license if she is convicted of DUI or a 2nd DWAI in 5 years or DWAI if under 21yo. There are lots of pleas that can avoid a further license loss.

DMV hearings and criminal cases are different jurisdictions with different outcomes. The criminal case is next and competent counsel will be the best way to avoid any drivers license suspension.
