Legal Question in Family Law in Colorado

Hiding Property From Spouse

My husband is full blood Southern Ute. He put all his vehicles in his nephews name. These are things he has aquired since marriage. Isn't it against the law to hide property from your spouse? I am non-tribal. White. I don't do this to him.

Re: Hiding Property From Spouse

First, your raccial status and your husband's racial status do not matter. Whether he is Ute and you are white, or whatever, is irrelevant. Second, the vehicles are indeed marital property, although the vehicles can be titled in the name of anyone he chooses. However, if the vehicles were titled in the nephew's name solely for the purpose of hiding those assets from you, then the vehicles are not only marital property, but your husband, and perhaps also the nephew, have committed a "fraudulent conveyance", and may be liable to you for damages.
