Modifying Child Custody/Visitation Rights

How can I obtain visitation rights to see my child? I live in New York. Her father took her to Colorado without my knowledge. He has full custody. I was able to locate her after 3 years. And they refuse to allow me to call/write/see her. How do i go about starting this in CO without being in CO?

Congratulations on your persistence and love in finding your child. This has been a difficult time for you and now you will be able to make progress more quickly in establishing visitation.

My answer on the legal issues will be based on some asumptions of facts that you have not yet explained.

Your husband has committed a grave violation of his duties as the custodial parent. He has taken your child out of the jurisdiction without your approval or notice. This is very much discouraged by the law and all judges. This is a 'change of circumstance' that will justify changing the original custody and visitation order.

The original order giving custody to your husband will give direction on exactly how to proceed - a court order to give you visitation in 2 weeks blocks or giving you full custody are two options. But the door is wide open to make changes and get your child back.
