how can we proceed

my mom went to usa where her family has immigrated after her marriage 1 yr ago on a visitors visa and indian passport. it was jus for meeting her parents there. she is maried to dad though as you may be aware in india she was married in the traditional way way back in 1975 and there is no certificate etc after going there and a span of 4 mnths she suddenly married a man there and applied for immigration on marriage basis we were not aware of it till recently now we cannot go to the usa to file a case against her and she has already obtained us citizenship and wont come here so what can we do to charge her with bigamy and nullify her 2nd marriage

Your mom was married in India, hence, she is governed by the Hindu Marraige Act,as applicable in India. You need to file a petition for restitution of conjugal rights in District court and also file a complaint case before the Magistrate of your area for bigamy against her. The court would summon her here and you can handle the situation accordingly at the relevant time. Further how the situation turns,it is to be dealt in the according situation.
