Legal Question in Immigration Law in Colorado

immigration

My husband came to US in April 2008 on K-3 visa. We are in process of adjusting his status to permanent resident. He has not received his work permit, SS card or gren card yet. However, I believe he is in the process of trying to leave me to go live with his sister in Arizona. I feel he has used me to enter the US and now I need to know what I need to do to protect myself legally.

Re: immigration

If the I-485 package has already been filed with USCIS, you can write a letter to USCIS withdrawing your support, but reference the receipt numbers. You would have to be married to file the petition, so if that has not happened, then the petition is still not filed and you can refuse to sign anything.

If you do not marry within 90 days of his arrival to the U.S. on the K-3 visa, he is in violation of his status.

If you did marry and the I-485 package was filed with USCIS, your husband may get a work card and SSN, but he should not get a green card without an interview that you must attend.
