Estates and executors

As an executor to my late brother's estate I have to action the decedent's will is Zimbabwe. He passed away in Australia. The son who is in Australia is the sole beneficiary. His estate includes shares in property and bank accounts.The shares in the Zimbabwe property are related to our late father's will and are linked to a partnership with three brothers. The one brother who resides in Zimbabwe was distributing financial benefits for the share holders. He has recently dissolved the partnership because of the death of a partner and prorated the shares with the other existing shareholders. This means that the beneficiary is excluded from his entitlement. As an executor I need to secure the Zimbabwe interests for the beneficiary while I am residing in Colorado, USA. As the executor I am worried about what steps to take to satisfy both the Zimbawe authorities and the beneficiary's interests.The brother in Zimbabwe has already notified the High Court. He has done this in order to expedite the transfer of the title deed of the properties which were under the partnership. Please would you assist me with this problem and let me know what the quickest way would be to fullfill my obligations as the executor.

You are in a difficult situation which is also complex.

The laws in Zimbabwe with respect to the intricacies of estates, partnerships and stock ownership differ from the laws of the United States. In fact, such laws differ in the USA from state to state. Usually, the laws of the U.S. state and county in which the decedent died govern how a decedent's estate and business interests must be transferred to survivors.

If you wish, a Colorado attorney can certainly review the documents you have and attempt to correspond with the proper authorities in Zimbabwe to advance your point of view. I would be happy to do that for you.

You have a serious fiduciary responsibility to fulfil and that is obviously rendered difficult by virtue of the asset's location in Zimbabwe. You need to retain good counsel in Zimbabwe. I devote a lot oof my international practice to locating foreign counsel, supervising their activities and then acting as a liaison between the U.S. clients and the foreign lawyers.
