Legal Question in Real Estate Law in Colorado

Real estate rights

I went in with another person and purchased a home. We do not get along very well. Been in the property 6 mos. now. I want out, he wants to stay. He will not consider renting and will not buy me out. What are my rights in this situation? Market stinks, not a good time to sell. Thanks, DW

Re: Real estate rights

You two are likely holding this property as tenants in common. If you two cannot come to an arrangement regarding the house your only option is to go to court and file for a partition of the property.

The partition is a suit where the court has the power to enter such orders as it deems necessary to completely adjudicate every question and controversy concerning title, rights, and interests.

I would try to come amicable agreement if possible or you will need to file partition. Contact an attorney to assist with the agreement or the suit. Good luck.
