Legal Question in Traffic Law in Colorado

incorrect date for appearence on citation

My son received a speeding ticket on Dec4th 2002 and appeared at the written time/date on the citation , we were told that there was a arrainment at that date /time, we checked the posted docket. He was not on it, the clerks checked the computer and there was no record of his ticket. I asked for and received a note stating that we appeared at the written time and place . My son has since received a summons to appear at another date because he failed to appaer at the first date. Is there grounds for dismissal.

Re: incorrect date for appearence on citation

There is a jurisdiction argument, but I do not think it is very good. Basically the argument is that the court has no jurisdiction because the ticket failed to show a court time and date and place. There was no service of process. Since a summons was served on your son, there is now service.
