Legal Question in Wills and Trusts in Colorado

Is my sister responsible for her dead husband's medical bills? There is no life or health insurance. She has no job. There was no estate. They just filed for bankruptcy the year before.

She should not be unless she personally guaranteed them. Even if she is liable, she likely could file for bankruptcy again if it came to that. Hope this helps.

Your question will depend on several factors. Your sister may have signed as a responsible party for various medical services. Doing so makes her responsible.

Second, her husband's creditors may seek claims against his estate and open it on their own petition. If they shared assets, creditors may pursue claims against her concerning those.

Recommend to her that she seek guidance from an attorney in her area that specializes in estate administration of small or no asset estates.
