Legal Question in Wills and Trusts in Colorado

Small Estate Affidavit - File in Which State

My Dad lived the past 4 years and died in the state of Arizona. His only property is some cash in a Colorado checking account held jointly with me, one of his Executors. The other Executors of his will are my 2 sister and 1 brother. - Question: Do we file the Small Estate Affidavit in Colorado (the location of his 'property' (cash only)? Or do we file it in Arizona (where he lived and died)? No real estate is involved and the estate is less than $20,000.

Re: Small Estate Affidavit - File in Which State

If the only property is a small bank account in Colorado, it should be filed in Arizona where he lived and died. With some simple documentation, you should have no trouble obtaining the contents of the bank account for distribution.
