Construction across street caused damage to my house, are they liable?

They are building an apartment building across the street. I believe the vibration from the construction caused a crack in my basement wall, which I am now getting water through after heavy rain.

Is the construction company across the street responsible in any way, and if so how do I go about rectifying the situation?

I've already spoken with my insurance company and they do not cover that.

The construction company might be liable for the damage, if you can show that it definitely was caused by them. I would start by asking other homeowners in the area if they had similar problems. That way, you will get an idea of the strength of your case. You could also contact the construction company directly and tell them of the problem. They might admit liability or they might deny it. Lastly, you should talk to an attorney who focuses on construction litigation to review your options. Keep in mind that statutes of limitations could bar your suit if you wait too long.
