Merchandise Return Dispute

I purchased a used computer monitor for $60,the screen was distorted and made me queezy.I emailed the store the next day stating the problem and said I would return the item the next day.The sales receipt said One year Exchange warranty in one place and No Refund/Exchange on unopened Mdse.on the bottom.Signs in the store said items could be returned with a sales receipt. My daughter took the monitor back to the store,the clerk would not refund my money. She said we did not want another monitor and pointed to the sign which stated the return policy.The clerk was rude,and my dtr. asked to speak with the owner, she could see him sitting in the office. The sales clerk said he did not have time for this.I placed a stop payment on my check and my daughter returned to the store,left the monitor with the seller and told them a stop payment had been placed on the check.Now 6 months later,the owner filed a claim in small claims court asking for $283.60,he is suing for the original cost of the merchandise (we gave it back),plus $20 for bank fees, a $200 administrative charge and court fees.Do I have any recourse or any rights here, or did I make a big mistake. Can I countersue and charge admin fees also.

You have defenses, and possibly a counterclaim under CUTPA (the Unfair Trade Practices Act), but you will have to fight it in court. Make sure you answer the complaint in time and get all the evidence you can for the hearing.
