If it was a recent event, you should find out whether or not your bank paid the overdraft or the casino suffered the loss. If you can, go to the bank or casino depending on which entity realized the loss, and make restitution in the amount of the overdraft and any bank charges incurred as a result thereof. If the overdraft was $250.00 or less you could be charged with Larceny in the sixth degree which is a C misdemeanor and carries a maximum of 90 days in jail and/or a fine. The grade of misdemeanor increases as the amount of money involved increases. If it reaches an amount high enough, the charge turns into a felony charge. There are also other criminal charges that may apply depending on the specific facts of your case. Even if you make restitution you may still get arrested regardless of whether or not the check was deliberately issued with knowledge that the funds were insufficient or issued on a closed account, but if you make restitution up front the prosecution will take that into consideration in resolving your case.
