Legal Question in Family Law in Connecticut

automatic court order

My husband served me the divorce paper unexpectedly. I have been separated from him (no legal separation) for a year. I have put a deposit for buying a one bedroom to live in and have signed the contract. If I back off I will lose my $25,000 deposit. My feeling is as I have signed the contract I have to go ahead. Am I going to be incontempt of court?

Re: automatic court order

You most likely will not be in contempt based on the facts given especially since you both were seperated. However, this opinion is subject to the facts given and may change. If you want to provide more facts, you can email me at [email protected].

Re: automatic court order

The automatic orders prohibit you from "transferring" any property or incurring "unreasonable debts." Under your circumstances, I think you can go ahead with the purchase because the debt you are incurring (the mortgage on the 1 bedroom) is not unreasonable, particulary if you stand to lose your deposit if you do not go forward. Of course, the safest way to proceed would be to get a court order approving the purchase. Please call me if you would like to discuss this or any other aspect of your divorce further. (Simply because you have been separated for 1 year in and of iteself does not mean you husband cannot make claims against your property and vice versa). You may reach me at my office (860.236.9350) or mobile phone (860.977.0660).
