visitation issue

I have a 7 year old child that does not want more time with Dad and that doesn't want to spend the night. Her fater continues to tell her things about Mom, NaNa that she does not need to know. The last 3 visits he has not shown up or called to say he wasn't. At what age can my daughter decide when she wants to go? He guardian ad lib uses the saying that she could be comfortable in a lions den. I don't think we need to put her in one.

She's going to have to be 13-14 before the court will consider her wishes, unfortunately. The statute says when the child "is of sufficient age and maturity". However, if he keeps missing visitation, and that causes you (provable) problems (because, for example, he's supposed to pick up Sat at 6:00 PM & you make plans for the eve, and he doesn't show, screwing up your plans), you can get the court to order him to pay expenses, etc., or maybe threaten him with a cut-off of visitation if he doesn't behave (they rarely follow through, however).
