Im in the process of evicting my tenant for not paying rent. she got the eviction papers today. 1 pm and called me at600 pm and said she has most of the rent money and wants to stay .what should i do ?

The question simply is do you want to keep this tenant, or do you want the tenant out? I take it that by "she got the papers today" you mean a notice to quit was served on the tenants.

One question is, did the notice to quit have a use and occupancy disclaimer on it? This would allow you to take in the money as use and occupancy and not rent.

If not, when you serve the tenant with a complaint, you could also serve a motion for use and occupancy payments, which the Court would act on at your next court date.

You could always accept the money as rent, and reinstate her as a tenant and never act on the notice to quit, and hence stop the eviction.
