Second-hand smoke

I have been living in a new apartment for less than a week. The second-hand smoke coming into my apartment is terrible. I would like to break my lease b/c of this but the office manager says it is a 60 day notice plus 2 months rent penalty for breaking the lease, which I signed. She was completely unprofessional to deal with. Is there any way around this b/c of the reason? (harmfulness of 2nd hand smoke coming into my apartment). The maintenance man came and said himself that the smoke smell in my place is terrible. People also smoke in the area right outside my door (the laundry room) and that is entering into my private place, not public, that I am paying to live in. The lease I signed has sections in it that I feel they are not upholding, such as ''enjoyment of living space.'' How come they are free to not live up to their end of the lease and I am expected to under these conditions. I am miserable, please help. Thank you for your attention.

It appears you have a claim against the landlord;however,to receive a reliable answer,you need to bring your lease to a lawyer so the actual document can be reviewed. Dennis P. McDonough
