Delayed processing of estate - where to begin

Stepdad died in 2002. He was on Title 19 from August 00-June 02, but disqualified from June 02 until his death in Sept 02. I was POA. Due to family issues I have not processed any paperwork. I am the executor of the will. I paid $2500 out of my pocket to move his funeral to NY (he had pre-paid $5500 before turning over his assets to the state (approx $150K). He received a monthly pension into his bank account, but was overpaid $2200 in error. His union wants it back. Since I am no longer POA, I cannot return the money. Should I go to probate court and let them name me executor to pay this debt or turn everything over to the state. When I notified the state of his death in 02, they told me they didn�t have time to administer it, and I should. Also, can I claim the $2500 I paid out for the funeral as a debt? Where should I start?
