Legal Question in Criminal Law in Delaware

Extradition from VA to DE for a P.F.A. violation?

yes, i know i may go to jail for a phone call. this will be my sixth P.F.A. against me with the same person. this is the only one that the other person has ever called me on. yes it is a controlling thing, she does not want me to see my child. she is doing this because she wants me to give up my parental rights. i now live in VA the order is from DE what is the likelyhood that i would be extradited? what is the likelyhood that a judge will see she is abusing the pfa system? i am supposed to turn myself in in a week. i am afraid. i was only trying to remain on good terms to get a chance to see my child. i was in WA state she was in DE state at the time this last PFA was emposed. ???? ok. this is a very long and detailed story. the short is, i need to know if DE state police will actually extradite someone for violating a pfa from out of state, the other is what is the likelyhood that i will see any time. no one at anytime was harmed. and there were never even any fights on the phone. she is just being vindictive. she has never turned me in before, in all cases she has gone to court to have them removed. i do not want to contact her i dont care about the order she can have it, i just want to see my child that i pay support for.

Re: Extradition from VA to DE for a P.F.A. violation?

States don't normally extradite for the kinds of violations which you've described. However, if this is your sixth violation of a cout's domestic relations order, it's possible that the judge could find you in contempt and throw you in the slammer a few days, if you were to surrender voluntarily. (A Delaware lawyer practicing in the jurisdiction where your court is located would be in a better position to addreess this particular issue.)
