No, it is not (illegal), neither in D.C. nor Virginia; both are so-called one party jurisdictions where such taping can occur legally if only one of the parties to the conversation is aware of it(yes, that means the person doing the taping).

However, in two party jurisdictions such as the state of Maryland, both parties must consent in order for it to be legal.
