Legal Question in Immigration Law in District of Columbia

Military Children Born Outside USA

My husband served in the USA Army in Japan and held a green card at that time. We had two sons while there. The children are now in Kenya and my husband died last year (as A U.S citizen in active military duty at the time of death). What is the immigration status of these two children (3 and 4 years old)? They could not get re-entry visas from Kenya and they cannot receive social security benefits. What should I do to get citizenship for the two children?

Re: Military Children Born Outside USA

You have not indicated what your citizenship status is as the mother of these children but if their father died as an active duty member of the U.S. military (and citizen), there is undoubtedly a provision within Title 8 U.S.C. of the immigration statutes which either affirms the status of these children as American citizens or

describes what procedures are still required in order to finalize their respective statuses as U.S. citizens.
