Legal Question in Medical Malpractice in District of Columbia

suing an hmo

I was a patient with kaiser permenente for several years. I complained of chronic knee pain to which they took a xray and perscribed anti-imflamatory drugs. After complaining the pain was not decreasing in fact it was getting progressively worse, I was sent to a specialist. A series of steroid shots were given but the pain still exsisted.

Recently I have obtained another insurance and have since had surgery. It seems that a simple MRI would have shown the actual problem and years of pain could have been avoided. Can Kaiser be sued for not taken all measures to diagnose there by avoiding prolonged pain, lost wages, termination from employment etc?

Re: suing an hmo

Maybe, or maybe not(if their course of prescribed treatment fell within the generally recognized standard of care prevailing within that medical community at that particular time).

Many more facts and information would be required in order to make a credible determination on this issue.
