Legal Question in Business Law in Florida
If the company I contracted for wrote"cashing of this check is agreement to final settlement"on a check they issued me and I deposit the check are they no longer libel to pay me additional money that is owed. Also since they have deducted money from my settlement check is this considered theft by deception.

As a Franchise Attorney I can say this is not a question that can be answered without a detailed look at the surrounding facts and circumstances. Generally speaking, if you cashed the check containing that statement, you are likely bound. There's no theft involved if you agree (by cashing the check) to the novation. This happens all the time. Consult with a good business or franchise attorney in your area for specific advice.
