Florida law on cancel check for deposit

I gave a deposit check for a used SUV then I was told financing was worked out on that SUV. When we went in to the dealership they wouldnt get into the SUV and tried to get us int a cheaper run down car and they deposited our check when they said they would only hold it. We wrote on the memo part of the check it was for the 2004 Lexus SUV. We stopped payment on the check. Is that okay to do in Florida?

It normally is not but you should be able to justify your actions in this instance. You should report this dealer to the BBB and state attorney general's office just to back up your position. But it doesn't sound like you are locked into paying them any more. Go elsewhere.

No. It is not proper to stop payment on a check. Should a complaint be filed, the court will look to your reasons and you may be ok, but that does not make your actions proper or justified.
