Legal Question in Business Law in Florida

Small Claims against Business

Me and our business have been taken to court by an independent contractor- (small claims). I provided all documentation showing she did not fulfill her contract. I am in Florida and she is in Alabama. I received an ''electronic filing'' stating I needed to appear in court on Nov. 27th. How can I not appear and get this taken care of?

I assume you are dealing with small claims court in Florida otherwise I cannot be sure of procedures in Alabama. Generally, if you are being sued in small claims court you must appear or a default will be entered against you and the company.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You will either need to appear or hire an attorney to appear on your behalf unless you can settle the matter amicably prior to the court date. If appearing in court is a major hardship (and not just an inconvenience) one other possible alternative is to call the court and ask to appear by telephone.
