Legal Question in Construction Law in Florida

I paid a deposit to a contractor . he never performed any of the work spelled out in the contract. he offered to reimburse me for the deposit. i accephted his offer and he gave me a check for the deposit, in the amount of $2500.00. the check subsequently was returned to my bank, for non sufficient funds.

i live in florida. what legal recourse do i have?

The long and the short of it is that you demand him to return the money either through cashier's check or money order, or you sue for 3 times the check amount.

The big question is: can you actually collect money from this guy or is he "judgment proof"?
